My husband has been working for this trucking co. for 2 1/2 yrs & is wanting to leave b/c they treat him like crap & he isn’t making much money. Also, he picked up a load & then shortly after this 4 wheeler was in his lane trying to pass a bread truck. He had to slam on the brakes and get over on the side of the road to avoid a head on collision. Even though he had a load lock on, the load was damaged, his company was P.O.’d & they are claiming he has to pay for the load! Can they do that? If they take it from his check then what?
They won’t release his employment info to a company he’s applied at. Said they had 2 weeks by law b4 releasing. It’s been over a month, now they are claiming they sent it twice, but other co. never rcvd. Is there a law 4 that?
If he were to just up & quit how soon could they load his DAC up? We know they will put a bunch of BS on there out of spite. What do we do?

As far as the damaged freight goes, the company can pretty much take whatever they want out of your paycheck and you’re going to have to sue them to get it back. But do I think that they actually WOULD take it out of his check…no. This is why trucking companies have insurance on EVERY load that they touch. The insurance will pay for the damage and maybe the company is trying to get double reimbursed, but I think they’re just talkin’ crap. If they take money from his check, just take them to court…and while you’re at it, sue them to release his employment info to prospective employers. This would be called “suing for specific performance”. I’m certainly no expert on the law, but I know of no waiting period for them to give out this info. AND, if they falsify info to prospective employers, you can sue them big time for damages to your livelyhood and ability to earn money!!!!! I’m sure that the company is aware of this and so I think at this point, they’re just trying to make it seem difficult for him to leave. Give a two week notice and quit, (it will make you look better if this does go to court), make sure to drop off your last load and the truck according to your employee handbook, and get a different gig. With his mvr, which we talked about before, he shopuld have no trouble getting another gig. If it’s any comfort, I went through the same deal because the last place I worked for closed for tax reasons in january, my boss could not be reached to give out employee info because the tax man took everything, including the office. All I had for him was a cell phone number which he never answered because he still owes me money, so I had my father call him and play like an employer, and when my boss didn’t return the call, I called him and left a message threatening to sue him for backpay and damages if he didn’t start answering the phone. I just now am going back to work, so I guess that worked. By the way, what general area do you live in?? I REALLY like the place I’m at (only been there less than three weeks) and they have been very good so far about keeping their word. If you live in their lanes, it might be an opportunity. Email me!
